Aura Terms of Use

Aura is a product operated by KIKI World, Inc. (“KIKI,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your use of the Aura application, websites, and related services (collectively, the “Site”). By visiting or using Aura, you agree to be bound by these Terms and by our Privacy Policy.

We may update these Terms at any time. Any changes will be effective immediately when posted, with the “Last Updated” date reflecting the latest revision. Continued use of Aura after changes means you accept them.

1. Overview of Services

Aura provides a platform that enables:

• Creators to launch brand or project presales that may, if successful, result in the issuance of community or brand tokens (“Tokens”).
• Supporters to back these projects during presales.

Aura functions only as a platform. KIKI does not create, endorse, or guarantee any project, presale, or Token. We are not responsible for the ultimate success of any Creator’s project.

Important Disclaimer: Participation in presales involves risk. Tokens are not investment products, securities, or equity in a company. Tokens may not appreciate in value, may lose all utility, and confer no ownership rights. If a presale does not meet its funding goal, Supporters’ pledged USDC will be returned, but otherwise no refunds are guaranteed.

2. Account Registration

To use Aura, you must register an account. You agree that:

• You are at least 18 years old (or at least 13 with parental/guardian consent).
• You will provide accurate information and maintain the security of your login credentials.
• You will not impersonate another person or use a username that is offensive or violates another’s rights.
• You are responsible for all activity under your account.

We may suspend or terminate accounts at our discretion, including for security or legal compliance reasons.

3. Creator Responsibilities

If you are a Creator:

• You must accurately describe your project and presale terms.
• You are solely responsible for fulfilling the commitments associated with your project.
• You must communicate openly with Supporters about progress, delays, or changes.
• KIKI is not responsible for your communications, delivery, or project outcomes.

Creators agree to indemnify KIKI against any liability arising from their presales, communications, or Token use.

4. Supporter Responsibilities

If you participate in a presale as a Supporter:

• You acknowledge that Tokens are experimental, non-investment digital assets with limited or no functionality.
• You accept that presale contributions are final unless the project fails to meet its funding target, in which case your pledged USDC will be returned.
• You understand KIKI does not endorse or guarantee any Creator project.

5. Code of Conduct

When using Aura, you agree not to:

• Engage in unlawful, fraudulent, or harmful activity.
• Harass, threaten, or abuse other users.
• Misrepresent your identity.
• Upload viruses, malware, or harmful content.
• Infringe on intellectual property rights.
• Use Aura to advertise, solicit, or promote unrelated products or services.

6. Ownership of Content

Aura, its design, software, and features are owned by KIKI and its licensors.

You retain ownership of content you submit (“User Content”), but you grant KIKI a worldwide, royalty-free license to use, display, and distribute such content for operating Aura.

You represent you have the rights to submit any User Content, including likenesses of individuals.

7. Intellectual Property & DMCA

If you believe content on Aura infringes your copyright, you may submit a DMCA notice to:

False claims under the DMCA may carry penalties.

8. No Investment Advice

Aura does not provide financial, investment, or legal advice. Tokens available on Aura are not securities, financial instruments, or regulated products. You are solely responsible for determining whether your use of Aura or participation in presales complies with laws applicable to you.

9. Disclaimer of Warranties

Aura is provided “as is” and “as available.” KIKI makes no warranties regarding uninterrupted service, project outcomes, Token functionality, or the conduct of users.

10. Limitation of Liability

To the fullest extent permitted by law:

• KIKI will not be liable for any indirect, incidental, or consequential damages.
• Our maximum aggregate liability to you is $100 or the amount you paid us in the past 12 months, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless KIKI and its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of Aura, your content, or your participation in presales.

12. Disputes & Arbitration

Any disputes will be resolved by binding arbitration in Los Angeles, CA, under JAMS rules, on an individual basis (no class actions). Small claims court actions may be brought in Los Angeles.

13. Miscellaneous

These Terms are governed by U.S. law.

If any provision is found invalid, the remainder will remain enforceable.

We may update or discontinue Aura at any time.
